How much does an RMPD penalty actually cost
12,000 zł for a missing filing or for data that does not match the facts (annex 3, item 3.2a of the Road Transport Act) and 10,000 zł for failing to transmit geolocation data (item 3.2b). The driver pays separately: 1,500 zł for not presenting the reference number and 2,000 zł for a locator that is off.
Where does the figure of 46,000 złoty come from
Nowhere. The SENT act says not 46,000 zł but 46 % of the gross value of the goods, and no less than 20,000 zł (art. 21 ust. 1). That penalty is not the carrier's, though: the percentage falls on the consignor or the consignee, while a carrier that files no SENT notification pays a flat 20,000 zł (art. 22 ust. 1). For the consignor a cheap load gives 20,000 zł, and more than 46,000 only once the goods are worth over 100,000 zł. No fixed 46,000 zł appears in the act at all.
Can one roadside check cost several penalties at once
Yes, but the total has a ceiling. Penalties from a single roadside check cannot exceed 12,000 zł (art. 92a ust. 3 of the Road Transport Act). Penalties under the SENT act are counted separately, because they come from a different statute.
Who pays, the driver or the company
It depends on the breach. The carrier pays for the filing and for geolocation, the driver for their own actions: 5,000–7,500 zł for setting off without a SENT number (art. 32 ust. 1 of the SENT act) and 1,500 or 2,000 zł for RMPD breaches. Two different pockets and two separate decisions.
How long is there to appeal
14 days from service of the decision, the same for RMPD and for SENT. After that, 30 days for a complaint to the voivodeship administrative court. A SENT appeal must carry its grounds and evidence from day one, while an RMPD appeal need not; the difference is set out in How to appeal a SENT or RMPD penalty.
